Lollipop Posted November 23, 2011 Author Report Share Posted November 23, 2011 They didnt want his business anymore, so either he cancelled or they did.Correct.at the time you were pulled, you had no insurance, thats a fact and the way any judge will see it, the only thing you can do is plead your case, well not you , you deffo need a solicitor to do that and a good one at that, going to have to go down the whole story then plead you need car for job, you are willing to pay a higher fine and if your licence is took away it would cause you hardship loose your job so no income. you are going to be done thats a fact its now down to how good a brief you get to barter for the best punishment for you.Yeah, thats the facts on the plate. But surely the fact i'm a 18 year old lad, scrapping a living as an apprentice.. But still paying all my taxes etc, Hard working, Honest, Never been in bother with the law. etc etc... Has got to work in my favor, Over being a 18 year old, drugged up alcoholic, scamming every penny I can via dole and benefits...?Whats the deal with solicitors etc? I've never needed one.No idea what your getting at...you need to talk to some bad lads to get the know on a good brief, after all how would you know a good one from a bad one, they all do law but you find that all briefs specialise in a certain aspect of law. as far as being a tax payer you must not be on the min wage for a apprentice of £100 a week and the bit Rich said is youve had job longer than license so loosing it wont cause you hardship in the judges eyes basically. Special Reasons ArgumentsIt can sometimes be argued that, whilst you are technically guilty of the offence in question because you were uninsured at the time you were driving, you have Special Reasons in relation to the circumstances in which you were driving, namely that you were driving under the genuine misapprehension that you were insured at the time. If you successfully argue that there are Special Reasons then the Magistrates have a discretion not to impose penalty points. In order to argue Special Reasons you would need to support your argument by giving evidence on oath and it is preferable to provide documentary evidence to the Magistrates in order to support your argument.You may be able to establish Special Reasons if you have been mislead by the insurance company or somebody else as to the nature of the cover in place and this lead you to believe that you were insured at the time you were driving. You might also be able to argue Special Reasons if the insurance company cancelled the policy without good reason and failed to notify you of that in advance of the offence. dd23 Posted November 24, 2011 Report Share Posted November 24, 2011 most likely out come is a ban, however it all depends on the judge, i borrowed a car once and got pulled,car had two front tyres on cords,argued with police and ended up in court and still managed to walk out of there with just a fine so you never know...................however your prob gona get a ban!
