If they sold you a car that is not 'fit for purpose', which they have, then legally they have to either fix it, replace it or give you your money back. Threaten them with court action. You will win and they will be even more out of pocket and they know it.

dont back down buddy even if it looks like Ur gonna lose!

Courts take a very dim view of dangerous cars on the road.

Think of it that way n the fact they are swearing n givin it the big un pretty much says it all t me, keep your chin up fella dont let ppl beat ya good luck at sorting it.

When buying a car from a second hand dealer does have its down points. Basically you buy what you see and you have agreed to pay such amount for the car. The only cover you may get is a warranty and once that's expired your on your own. Trading standards will not do anything

i agree with nock i have spoke to them and done about 4 hour research on it all and in my right car dealers have to selling a car that is fit for road use and a good standard .... its just hard when all my family / friend are tell me different things to do so i am going to writing a letter to them asking again for money then get the car cheaked by garage then back to trading if they do not reply :)

Park it infront of their forecourt with your four ways on and a big sign in the front window warning people of the trader , they will soon start talking.

Fit for purpose means, an MOT pass, and maybe a service. If the car has an MOT then its fit for purpose

Does it? I don't think it does actually....

so if the car dies and the power steering goes when i was on a roundabout that is fit for purpose ... ???

Exactly.

Fit for purpose means that it is fit to transport someone from A to B. If it cannot do this then it is not fit for purpose. Simples.

You don't understand, you buy a second hand car, you cannot expect to not have problems with the car, that's why you learn from your mistakes, like did the car come with a service history, maybe this will tell you why the car is like it is. ] If the car has run out of warranty then its up to you to get it fixed. The power steering can go on any car, I have had things wrong with my car and my warranty has expired.e The car was unusable Therefore according to you my car ain't fit for purpose, so I should take it back, is that what your saying. Like when you buy a kettle, it will have a warranty but if it stops working when the warranty runs out, you would still take it back is that right.

This is a good reason why some people buy brand new car, for example My sister, she was in the same position as you and I know how you feel, but its the way it works

When you bought this car you would have signed for it.

Who justifies 'fit for purpose'. and what about the pedal box issues with the lupo. That obviously ain't fit for purpose if the car stops working, but they will not fix most cars

i understand a second hand car will not be perfect but its only 8 years old i payed my hard earned money on a 02 plate that runs like a tractor from day one !! my friend has a 1993 escort and runs fine !! he payed 200 pound ..... i still have about a 2 week warrenty but i dont want them to fix it ... waste of my time now ... they wont let no ova garage but them touch it .... anyways my point is simply if you plain to buy from a car dealer the car should not have as many problems lets say as a private sale from the moment you get in the car till 2 and a half months after

This is what you need to do. Go to another garage tell them your problem and get them to diagnose every problem. Take the report to the garage and give it to them, if they refuse you can go trading standards. This is the only way you can get this sorted. Where about are you?

Taken from trading standards site

When you buy goods from a trader' date=' you enter into a legally binding contract governed by the Sale of Goods Act 1979, as amended by the Sale and Supply of Goods Act 1994 and the Sale and Supply of Goods to Consumers Regulations 2002. [b']If you buy a used car from a trader it must be of satisfactory quality, fit for the purpose, and as described. Obviously a very old car with a high mileage will not be as good as a newer car with a low mileage, but it should still be fit for use on the road, in a condition which reflects its age and price, and reliable.

Traders cannot take away consumers rights by using terms such as ‘sold as seen’. Your legal rights are reduced if you buy a car from a private seller or an auction. If you buy a used car via the internet, you may have additional rights under the Distance Selling Regulations.

If you have a problem with a used car, you have a short time after buying it to reject the car. If the fault was present when you bought the car, you do have other remedies such as repair or replacement. It is recommended you always follow up complaints with the details in writing, and keep copies of all correspondence. As a last resort, you may need to consider taking court action. Remember, used cars may have some faults, but they should not be excessive. Fair wear and tear is not considered to be a fault.

Hope this helps.

A car that is not able to run without cutting out isn't of a satisfactory standard/fit for purpose

If it comes to it small claims is very cheap and easy to do with regards to making a claim, all depends upon whether the garage you bought it from are a proper garage or some pikey place that only allow viewing my appointment
