Wear and Tear????

The main bearing in my gearbox had collasped leading to complete gearbox failure.

I have a Seat Arosa Sport on a 51 plate, and it has covered just over 28k miles.

I have an extended warranty on the car with an indepedent company. I took the car to a garage recommended by said warranty compnay. The gearbox has been removed, split and inspected. Warranty compnay has conatced me saying that they won't be paying out due to the part failing due to "Wear and Tear".

Am I on decent ground to contest this, or haven't I got a leg to stand on?

Need some advice, as the garage is complaining that my car is taking up ramp space!

Unfortunatly these extended warranties are not worth the paper they are printed on.

Do you have a scanner?

If so scan it and pm me I'll give you my email addy and I'll have a read of the small print and tell you if you have a case.

They will try and get out of it in the same way the dealers do but pressure them. Its also worth doing some digging
to find if its a known fault across the VAG range. Quite often faults are known like the pedal box but they will not want
you to know. If you can go into a dealers with information of a problem you can sometimes get things done on goodwill
even outside of the warranty.

VW said that no way would they do my pedal box free. After a little chat they fitted it in the next week.
28k is no way normal Wear and Tear. A modern gearbox should withstand at the very least twice that before any wear and
tear starts effecting it.

I would find out what the warranty guidelines are from Seat regarding the gearbox to give you some idea of what the
manufacturer states as normal Wear and Tear.

Yeah, I've tried to do what research I can. I can't seem to get anything official from Seat as it is out of the manufacturers warranty. I'll see if I can get soem "wear and tear" guidleines off the dealer's.

My arguement is as you have stated, no way should a 'box fail after 28k, surely this is abnormal?!?!

These companies rely on people giving up - unfortunately nowadays if you want to claim for anything whatsoever, you've got a fight on your hands. Good luck.

Cheers John. Yeah, these companies seem to rely on people that will just back down and bend over. Hopefully because I've shown resisitance to their claims, I hope to get a payout.

To make it even funnier, it actually states on the "Covered Parts" summary, that the part that failed is included! Just that they cliam it come under their wear and tear exclusion!

We used to phone them and say a bearing had 'broken' and they never questioned it just gave us parts and three hours.

Couple of years back they changed and became just as bad as the others.

We could have two 'boxes fail with the same fault, the first would get paid but if one of our lads used the word 'worn' by mistake they refuse.

Did you find anything on watchdog?

Yeah I think the "gearbox specialist" must have metioned "wear to the bearing".

I recieved a letter from the warranty company today;

............."the main shaft bearing within the transmission had failed and required replacing due to wear and tear. The wear within the bearing had caused misalignment within the transmission causing consequent damage"

Bull!

I only took it to this garage because the warranty company advised me to do so. Had it failed and I wasn't "covered" by a warranty, I would have no way taken it to this garage.

Didn't really find much on the Watchdog website, Tigz.

Think I'm going to have to pay the £1k bill for it, to get it out of the gearge, and try and pursue it :angry:

Where do you live?

The warranty company recomended the place?

I'd get an independant inspection if it was me.

The main bearing normally failed taking out the input shaft.

An independant may find the bearing had failed, rather than worn.

Will be calling this "gearbox specialist" today and try and get an explanation from them.

My dad said he had the same situation on one of his cars. He had an independent inspection done at a very very well respected gearbox place and they came back to him saying it was a defeat that had caused it rather than normal wear. If you dont have much joy with the warrenty take it to somewhere of your choice to get the work done.

Why £1k? I paid £620 for a recon gearbox and you can have whatever gear ratio's you want.

They used stainless steel parts to stop certain parts snapping too.

Because they are a bunch of thieving b*stards! As I said previously, had I not been covered by a "warranty agreement", I would have taken it elsewhere. I have that option, but I will need to pay the garage that has my car (albeit in pieces) for the work already done, then I'll have to shell out again to get the work done properly. Even the guy who runs the garage is agreeing with me, it's just this "transmission specialist" thought they'd piss on my chips, either that, or the warranty company decided to feed me Bull.

If you did not authorise the work then you dont have to pay. If it was under warrenty it was there duty to either

undertake the work under warrenty or let you pay for the work to be done with your instruction otherwise you

can make your own arangements.

It sounds like they have pulled a bit of a fast one on you.

So the repairing garage thinks its a failed part, not a worn part?

Did the warranty company send someone else out?

If so, it needs an indepenant inspector in (paid for by you) as both parties do not agree with the diagnostic.

Yeah, I can see what your saying. I haven't authorised them to put the new gearbox clutch etc. on the car yet, but I did ask them to proceed with sorting the new 'box out, as at that point, I thought I was safe with the warranty behind me.

Now the garage are complaining that my car is taking up space. If the warranty had paid out, I would have my car back by now :angry2:

If you did not authorise the work then you dont have to pay.

He has authorised them to take the gearbox out, although if the warranty company has requested the gearbox be stripped then they should cover the cost of that.

I may know of someone who may be able to rebuild and fit the box for you.

Sound, that would be cool. Where are they/he/she based? I'm still trying to get these b*stards to do it, like they should be doing. So if all else fails, your further assistance will be greatly appreciated! :shades:

Right...I sort of skimped through this thread. sorry.

I sold my Lupo for a modern Polo to save money and the gearbox is starting to feel gay already or gay by design.

OK, a quick update. I am f*cked :angry2:

Called the guy who inspected it, and he is adamant it is Wear and Tear, he nor the warranty company are budging.

Now I am faced with £1k bill. Not happy :angry2:

Well, yes that would be great. I'm not sure whether they'll budge though. I'm stuffed now though, so any help I can get would be great. Just I don't have the money to pay the bill.

Did you want the Garage's number or the Gearbox place's number?

Oh God help them!

Im sick of argueing with Mercedes John, in the past 3 hours I have authorised 3 invoices, its a joke.

They seem to think its acceptable to send us invoices for every fault, and wait for us to query it before they put a warranty claim through :rolleyes:
